You missed the analogy. Using the standards for a native speaker on a non-native speaker isn't right just like using standards of today to judge choices and behaviour of 4 decades ago isn't right either.
May i also advice you if you want to take the moral highroad not to lower yourself by a cheap shot at Americans as it weakens the point you're trying to make.

You judge based on imagined motives of a total stranger, whereas I judge Albert's factual actions / inactions for which Delphine has gained legal redress. "First they ignore you, then they laugh at you, then they fight you, then you win." Delphine rocked it, and so sorry that it gauls you.
