I wasn't a NASCAR fan back then, but in the real world, if you punch someone, you face criminal charges. The victim doesn't even have to be the one to press charges. I've heard Spencer talk about his feud with Kurt before, and he doesn't seem to regret his actions and seems to think that he helped Kurt change his ways. I doubt he was the sole reason!
