If band exists at the student's school, they must be an actively participating member of the band. Nothing on that page says that the band director must be the sponsor, just that the sponsor must be a TMEA member. But I do wonder if there's a reason why the band director won't sponsor the kid.
If band doesn't exist at the kid's school, any active member can sign them up. In the past I've signed up a violin player who transferred in from another school. We don't have orchestra, but they had learned the music and wanted to audition (and they made it). Home school parents can join TMEA and sign a kid up.
The only other time I've seen a situation like this was a kid who dropped band and was taking private lessons. In that situation no, the student is not eligible.
