Neither, the rule says the driver that starts the race gets the points. They have given HMS a waiver already, when Elliott, injured from something other than racing got one. Drivers that are injured racing in Nascar events should be given the waiver, not those just wanting to do something different.
I am sure that HE will get it as he belongs to HMS and they control Nascar.
