Copyright Confusion

We went to marching UIL recently.

We received a video of our performance from the event.

Will sending this video to our students in the Band App violate any copyright laws?

We regularly send videos taken by parents during games or contests, but I thought there was a law about an official UIL video.

I've tried looking up this law online but every answer is very vague and unclear.

So I think you're fine since the BAND app is not public. If you paid arrangement rights, then you'll be fine.

The very line ABOVE what you quoted here is the one that applies.

Synchronization of audio and video content requires an agreement from the copyright holder(s); this agreement should also include performance permissions as the livestream falls outside the exemptions set forth in 17 U.S. Code § 110 (4), as illustrated in the “In-person concert” section above.

Even on Band App, it's illegal without prior permission.

I do not know the definitive answer to that question, but I just want to mention that I thought there was some stipulation about sharing something via a means that was password protected so that it is not publicly shared?

That's between you and whoever wrote your show. If you had a custom arrangement done, or bought a show in a box from somewhere, most likely you have limited sync rights to make a video if you want. If your show is stock charts from a publisher, probably not.

That said, there are thousands of videos on YouTube of bands, playing marching shows and concert pieces. It's highly unlikely that anyone will send you a takedown notice or cause you problems.

Unless you used John Mackey's work without paying for the rights, he's legendary for going after bands for that when he sees the video.

(No, you likely do not.)

In that case, yes, it would violate copyright.
