The district must adopt and strictly enforce a policy that limits the removal of students from class
for remedial tutoring or test preparation. A district may not remove a student from a regularly
scheduled class for more than 10% of the school days on which the class is offered. A student
in any grade level K–12 may not be given credit or a final grade for a class unless the student is
in attendance for at least 90% of the days the class is offered. An exception may be made if a
parent provides written consent to the district. (TEC §25.083(b) and §25.092(a)).
