I don't think I've had a marching show in the last sixteen years where we haven't rewritten something. Judges don't have a score in front of them, so there's no worries there obviously. If it's an original composition for marching band I'm sure composers will sign off on it. I always appreciate Randall Standridge writing multiple versions to where any instrument can play it. You can always ask your composer.
If it's something stock there may be a small copyright concern, but as long as you're just putting another instrument in place of the one I don't think it runs afoul of the law? It might technically be considered rearranging, but anyone in music education has had to rewrite even concert band solos to other instruments at some point in their career!
