At my last school I was mistakenly paid on an 11.5 month contract instead of an 10.5 month contract..for three years! The superintendent found the error when he went to the board to get the head director and I an increase in our stipend. He said the board discussed either a) making me pay the money back all at once or b) reducing my pay for the next year to cover the cost (if I was still employed by the district during that time, if not it would be option 'a'). The superintendent told them neither option was acceptable as it was not my fault (my contract said 11.5, but the position was supposed to only be a 10.5; they gave me the head director contract, but all of them just said "Classroom Teacher"). Instead, the superintendent told the board to give me an 11.5 contract.
That said, school districts are well within their rights to ask for reimbursement from overpayments and you are actually obligated to let them know you have been overpaid.
