A very good point. I do think however, that the school district attorneys could clarify and offer an opinion if they were given information, such as the actual Tresona case. Of course, if I or the district were sued for this, I would also expect the attorney of record to bring in specialists in that area of law.
The problem with copyright laws is that they are complex. The words in the code will have specific legal meaning, which is almost certainly different from common usage that you and I understand. The worst case scenario would be to make assumptions based on an opinion as a non-lawyer.
