There are no provisions in the nobiliary law to revoke a title. The King (present or past) and the Government can do nothing at all.
The only possibility in the law is depriving the present holder from holding it. Not easy, but possible. Even using that possibility, the title would not be revoked, but in abeyance, until that person dies and the heir claims it.
So, denying the present Duchess of Franco the inheritance of the title would be acting against the law, as the previous minister of Justice explained.
The case of Infanta Cristina is not comparable. Titles of the Royal House and nobiliary titles have different legal frames.
1. I would have no qualms with the government's position regarding re-interring Franco's body for the reasons stated.
2. I find it absolutely nonsensical for a government entity to suggest revoking a title or an honor bestowed by a former king or head of state. In this regard, the former king, Juan Carlos, conferred the title. Therefore, it should be he who revokes said title upon submission by interested parties requesting said revocation. However, Juan Carlos is no longer king and cannot revoke the title/honor accordingly. In other words, leave things be or as they are. Perhaps, the government will allow the title to die out.
Furthermore, the suggestion of revoking a title/honor bestowed on a person decades ago for whatever reason seems spiteful and petty in the least. Franco's daughter wasn't dictator but so was her father. Guilt by association, in this case family, is just an utterly trivial matter.
1. After several debates, the spanish government decided at last that Generalissimo Franco should be exhumated and casted out of Valle de los Caidos.
The Franco family has 15 days to tell the government where they want Franco to be reburied or the government will choose the place.
The Government claims that a dictator should not be buried in a public building .
2. The article claims that the government is thinking of revoking the Franco ducal title.
Such title was conferred by Juan Carlos to Franco's daughter.
Can the government revoke a title conferred by a king or should we understand it as a pressure from the cabinet for the king to act accordingly to the government's wishes ?
Is there any other case of depriving someone from a title, except for the dukes of Palma ?
3. A rather ignorant article on genealogy and titles, calling Henri duke of Paris or Jean-Christophe as head of the napoleonic cause and descendant of Emperor.
