Duke Max was also adopted by Duke Ludwig Wilhelm in bavaria beause he was descending from the dcual line through his grandmother marie Gabriele, tes sister of Due Ludwig Wilhelm.
For the other lines of the bavarian RF this is not the case.
Duke Max has also divided his posessions which come from the ducal line between his isters, for example his yougnest daughtr Anna now ownes the brewery in Tegernsee and Duchess Helene owns the families posessions in Wildbad Kreuth. So it could be that if the name Duke in Bavaria will be continued by ione of his grandchildren from his 2 younger daughters as this is possible according to german name law.
Im not sure the extended family was aware of Duke Franz not having offspring.
As for Max Duke in Bavaria adopting a male heir from a junior branch of the Wittelsbach dynasty to continue the IN Bavaria line: he is free to choose who he wants. Of course it might make sense to select a line that has male heirs but he could opt to adopt just anyone. He could also choose not to adopt anyone and let the line die out.
Is the succesion of the Dukes IN Bavaria submitted to any legal dispositions ?
This family branch died out with Pr.Luitpold in 1973, unmarried and w/o descendants.
His cousin Ludwig-Wilhelm (d.1968) adopted Duke Max-Emanuel in 1965 to continue the line.
Max-Emanuel was Duke Albrecht 2nd son and 2nd in line after his brother Franz.
In the family, I guess it was known that Franz was not expected to marry and found a family, so Max would be the heir of the dukes OF Bavaria.
A) If Duke Max will survive his brother will the 2 lines merge ?
B) Can Duke Max choose any line to continue the lineage of the dukes IN Bavaria ?
Before the demorganization of the various lines, the apparent succession would fall on Duke Wolfgang, Duke Rasso's son (his elder brother being a priest).
Now, the apparent heir is Duke Luitpold.
He has 3 sons - the elder, Pr.Ludwig is single, the middle one is married w/o children and the youngest is also single.
Is Duke Max compelled to appoint one of Luitpold's children ?
Can he appoint Wolfgang as sort of compensation for having lost his place in the succession ?
Can he appoint any other cousin ?
Is he bound to hear any kind of family council before deciding ?
