I am enrolled in land surveying at MVCC in Utica New York. I would like a professional opinion on were a deed line exists.
Two scenarios
1: You locate a stone wall (1000 feet over fairly level ground) and the variance from straight is 3 feet or less. The deed from 1830 describes a rectangular parcel by bearing and distance alone and miscloses mathematically by 30 feet. All other lines of the parcel are controlled by other evidence and the wall is 20 feet from where the bearings and distances would put the line.
2: You locate a stone wall (1000 feet over fairly level ground) and the variance from straight is 10 to 16 feet in irregular patterns along its length (zig-zag). The deed from 1830 describes a rectangular parcel by bearing and distance alone and miscloses mathematically by 30 feet. All other lines of the parcel are controlled by other evidence and the wall is 20 feet from where the bearings and distances would put the line.
What is the deed line for each scenario?
What is the controlling factor that determines this?
