A simple rule would be that only the possessor of the substantive title can have a spouse who uses that title as a courtesy title. An ex-spouse could use the dowager form of the title, but not transmit it to a new spouse. If the title was inheritable, only the children of the possessor of the substantive title could inherit it.
Again, it seems to work in Spain, where the Duchess of Lugo will eventually be able to remarry and her second husband can be called the Duke of Lugo. Jaime de Marichalar's new wife will not be able to call herself the Duchess of Lugo.
