I didn't want late pays on his credit. I knew that this could be yet another opportunity for me to make more money on this house. I get to sell all over again and collect another down payment. I have already talked to the now owners and to make a long story short, Mr. Homeowner can't keep his private in his pants, lost his business and wife is leaving him. His new job is not enough income to pay.... Wife is moving to an apartment and he is moving in with a friend. I already gave a good reference to the apartment complex against my better judgement, just to get them out. I still need to get him out though. I am going to do just what you said. I looked up landlord tenant law last night, and it's right along with what you say. After I file deed in lieu of foreclosure according to florida statutes 72 hours later I can file trespassing charges and get them out with sheriff. To file Deed in Lieu though according to contract If he won't cooperate I have to wait 60 days unless I can get in writing from him he can't pay, per contract, then I can file in 30 days. I had already planned on sending a certified letter stating that if he cooperated and moved out within x amount of days I wouldn't file the deed in lieu of foreclosure and quote the florida statute that talks about the trespassing and what would happen. Also that by me not filing exactly what you said about the future credit issues. I need to buy and sell more houses is the only problem here, then I have more cash and won't stress about things like this. No I didn't sign up for MREM, I will though.
