She was not his heir as he had a son living.She and her husband were invited to take the throne by Parliament after the latter mounted a successful invasion.The 1689 Bill of Rights confirmed their title to the throne and that of her sister after them whilst the 1701 Act of Succession vested the succession in the heirs general of Sophia,Electress of Hanover.James II & VII was the last monarch to reign by virtue of being the heir general of Henry II and not by Act of Parliament.
