Kinda hard to tell, since the whole issue was in flashback. I'll have to go ahead and read again, but it would appear to me at this time that she encounters Fury sometime after the formation of the Mighty and New Avengers, post CIVIL WAR, I would imagine, as he tells her to grovel for her reinstatement. This could have been before the Elektra arc. I'll have to reread later on.

Either way, she is in the know about the Skrulls deeper then anyone thought. She obviously has ways to get a hold of Fury that no one at SHIELD seems to know about.
