I don't think even though they said they were going to hit at him that it would be assault if they hit him and hurt him. If not using altered equipment. It is a fielded position, but according to some of you guys logic, if I say I am going to hit at the right fielder and do so and he misses the ball gets hit in the face and it breaks his nose, I could be arrested for assault. I doubt it. I don't agree with hitting at a pitcher, but it is a fielded position and a player can hit the ball at any position that he wants to during the game, if you don't catch it, it is not the players fault as long as legal equipment was used.
