I just had a foster dog with a situation such as this and the dog was not in the wrong...he was protecting his owner. There were other extenuating circumstances as well. He was considered unadoptable and was to be put down unless he could be permanently placed and adopted in a foster home already in the system. I would have kept him as he's a great dog with the right owner but I am in no position to take on another right now permanently. Luckily another foster home was willing to keep him. But...I liked him so much that if someone wouldn't have been willing to take him, he would have stayed with me until someone was because I sure didn't have the heart to put him down. And this dog was by no means "aggressive" but he did have issues.
A bite is a bite...no kill or not, the liability is too great. But, there are places that do take dogs like this. I believe Roy Hughes in Texas also takes dogs like this.
