May this will happen:
DENY
2. Appeal to the corresponding Circuit Court
IF they draw a Bushie panel - Affirmed (go to 3)
IF they draw a fair panel - Affirmed in part, but remanded for intentional torts (not constitutional claims, those will be tossed)
3. Petition for Writ of Certerori
If petition is granted (four justices must agree to hear the case), case will subsequently be tossed out by the conservatives on the bench.
Also, they can still sue under the Federal Tort Claims Act. And they should.
