I think the ruling was that the head is free to select his heir, so there is no legal requirement for GF to marry equal. However his grandfather selected him as his heir based on the marriages of his father and uncles so if he were to change that system he might be considered a hypocrite. He would have to resign as head and either let the headship of the family pass to his father's younger brother (the next in line with equal marriages) or to the oldest male line of Wilhelm II.
But as he is said to date a princess so he seems to be able to follow his heart and keep the within the requirements of the will of Wilhelm II.
