In Ultimatum #4, Kitty wasn't sure whether Peter was dead or not.

The only thing that indicated that Spidey died was Dr. Strange's statement to that demon dude. But remember, Dr. Strange was wrong about being able to take down the demon with a spell, so he could be wrong about Spidey dying as well.

A mask lying in a muddy puddle is almost always an indication that the character is not dead (in the comic world).
