I am assuming that you're referring to the awesome battle in Ultimates 2 #5.
You're right, Thor would probably be perceived as public enemy #1, but there would be the other half who would argue that he was fighting in self-defense. So the story would have continued in conflict.

So what you're trying to say is that by Thor being defeated in that battle, Loki made it worse for himself. It would have been in Loki's advantage to win that battle.
There is some logic to that I guess. On the other hand, Loki wanted Thor out of the picture for two reasons; (1) sibling rivalry, and (2) one less person who knew the truth about Loki manipulating reality so that he can continue his mischievous acts.
