well I would venture a safe guess of NO, if they found his DNA on the baton... how soon after the incident did he report it? how soon after the report did they do a dna test on the baton...
and thinking about that is GROSS as hell...

... image comes to thoughts... cop walks up to your car, window rolled up, he taps the window with the baton, leaves strange colored marks on window, you roll down window and the baton is close to your nose, and you inhale thru your nose and discover his baton smells like "butt", and you start wondering, just whose butt has been on the baton... you cannot answer any questions the cop is asking because you are really wondering how the butt smell got on the baton, then you are arrested because you cannot answer the cops questions... and then you wonder exactly where that baton is going next...
